Qualcomm says Broadcom claims are baseless

Qualcomm Incorporation, which has been sued by Broadcom by an antitrust case, claims that the accuser party has no base for their accusations. Broadcom has accused Qualcomm of making unjustified uses of their monopoly in the CDMA market by following discriminatory policies. Qualcomm on their part claims that they have given away more than 130 licenses without any issues by the contributing parties.

Qualcomm rebukes the charges of Broadcom and says that its patent portfolio is the largest in the wireless telecom market. This has resulted in widespread adoption of leading-edge technologies and promoted competition throughout the wireless industry. They also say that they do not have the claimed monopoly in the WCDMA market, considering they only supply only a small percentage of the WCDMA chipsets sold to date.

Louis Lupin, senior vice president and general counsel of Qualcomm said in a statement: “This case, like the earlier patent cases filed by Broadcom against Qualcomm, appears to be a desperate attempt by Broadcom to gain bargaining leverage through merit less litigation. Because Broadcom does not hold essential patents for the important cellular standards, Broadcom must feel compelled to resort to these kinds of measures rather than continuing to negotiate for licenses in good faith.”

Broadcom is known to sue companies like Intel, Microtune, and Agere and losing millions in legal fees. They also have two previous cases filed against Qualcomm in the courts before this latest one.
