This has nothing to do with the patents or law.

You have a product you put on the market and name it the same as an already existing product.
Any other company except apple doesnt get away with this and get blasted for being a sleazoid.

of course, Im sure the kool aid gang will claim-yell otherwise but then again these are the same people who try to convince us that a computer case that you bought SHOULD be sealed like its full of radiocative waste because 'we shouldnt go in there'.

It's not only that Creative didn't register the name, it's probably unregisterable for anyone. Since the word "nano" is a generic measuring unit prefix wich in both cases refers to the size of the device, you can't juridically claim that.

Nevertheless, it's occuring to me that Nano is rapidly becoming an Apple brand in the minds of consumers!

Didn't you wonder why the big news outlets didn't talk about this?

They didn't because Creative did not trademark the word "Nano"... They did trademark many other names, but not nano... Too bad for them :)

This is not a patent issue, so it doesn't matter that Creative released the Zen nano before Apple released the iPod nano.

As for Apple being unfair and stealing the name, Creative used just about every possible buzzwords to name their multiple mp3 players, it would be hard to find a "cool" buzzword not already used by them.
