Apple sued over their Apple iPod replacement offer
Apple has had a lot of success with their iPod range of digital music players. And they are continuing to sell them in huge numbers even now as well. However, the company has in the recent months faced legal hassles due to some defective units of iPods, which have been shipped in the retail market.
The latest such case has been filed by a consumer group which claims that the iPod nano player is defective because its screen is easily scratched and that the company is breaking its product warranty by charging $25 for replacements.
Los Angeles-based Foundation for Taxpayer and Consumer Rights claims that the recently launched Apple iPod nano cannot handle the pressure of daily usage and gets damaged easily even if the customer take extra care of it. In other terms, the design is flawed leading to easy damage to the external covering of this tiny device. More damage can lead to a non-working unit.
The lawsuit has been filed in the San Mateo County Superior Court and demands that the company should replace or fix the units for free and even refund the purchase price if the consumer demands it. It is also asking that Apple should add the scratching or cracking to its warranty coverage.
Apple was also recently sued for possible damage to hearing due to excessive use of the player at high volume. They have been asked to limit the upper level of volume on the player to a particular limit preventing hearing loss to their users in the long run.
