Apple facing lawsuit over iPod iTunes integration
Apple Computer has revealed that they are facing a lawsuit which claims that they have created a monopolistic situation by tying their iPod range of digital music players with their own iTunes digital music store.
This lawsuit was filed in July and focuses on company’s use of a copy-protection system that prevents iTunes music and video from playing on rival devices.
In a similar way, music acquired from other stores (loaded with some kind of DRM protection) cannot be played on iPods.
Apple did not disclose the name of the plaintiff. The company has suffered a minor setback when the courts rejected their demand to dismiss the case.
The company dominates the digital music player market with their iPod range of players. Apple also commands about 75 per cent of the market for downloaded music.

But its the music industry itself which forced DRM on the iTMS, not Apple.
My podcast, (which does not have any music that is not podsafe, meaning that it has NO DRM,) is downloadable and subscribable to from the iTMS ( http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewPodcast?id=120932170 )
The iTMS would be delighted to send out MP3s with NO DRM if it could, because it can and does do so already.
This lawsuit doesn’t have a leg to stand on.
The DRM is the Music industry’s fault.
