XM Satellite Radio faces Copyright Suit by Recording Industry
XM Satellite Radio is the biggest satellite radio service provider in the United States. The company now faces a copyright infringement lawsuit brought by record labels.
The lawsuit was filed by a group led by Sony BMG Music Entertainment, EMI Group Plc and others and the court has now turned aside XM’s request to dismiss the lawsuit.
The lawsuit claims that the company’s XM+MP3 service causes copyright infringement by letting the consumers download permanent libraries of songs.
XM had claimed that this service is similar in nature to the traditional cassette player which enabled the customers to tape radio programs.
The Judge said that by providing this service, the company both a broadcaster and a distributor, but it is only paying to be a broadcaster.
