International Trade Commission declines to suspend ban on Qualcomm phones
The U.S. International Trade Commission has confirmed that they have declined to stay their ban on the imports of Qualcomm chips and mobile phones which infringed upon Broadcom’s patents.
Qualcomm continues to work on appealing against this ban which is likely to affect several mobile service providers in the USA.
ITC said that the company failed to meet a “four-prong test” applied in courts trying to determine whether to grant preliminary injunctions.
They had issued the ban earlier this month and it is applicable on certain future mobile phones using Qualcomm 3G technology. Broadcom was also awarded US$19.6 million in damages.
The CTIA cellular industry association had also asked the US President urging him to stay the ban on these phones saying that it would affect the growth of mobile technologies in the country.
