Courts decline to delay an import ban on Qualcomm request
A federal court has now dismissed a request made by the technology company Qualcomm to delay the band on imports of their mobile chips which have been proven to be infringing upon patents owned by Broadcom.
The U.S. Court of Appeals for the Federal Circuit said in its statement that they do not have the jurisdiction to consider Qualcomm’s request.
The matter is still under review of the Bush administration which has until August 6 to take a decision on vetoing the import limits.
The courts further said that they would not consider an appeal on the issue till the 60-day presidential review was complete.
Emily Kilpatrick, a spokeswoman for the company said in a statement that the company is going to renew its appeal and seek a delay in the ban after Aug. 6 in case the Bush government does not reverse the import limits.
