Bajaj Auto to sue TVS Motors on Patent Infringement!
The Indian automotive market is now going to see some patent infringement lawsuits of its own!
Two wheeler major Bajaj Auto has revealed that they are planning to file a lawsuit against TVS Motors for alleged infringement of intellectual property rights.
They claim that TVS is infringing on the patented technologies which are being used on their bikes.
Bajaj has specifically stated that TVS has used its digital twin spark ignition technology (DTSi) in the just launched Flame motorcycle.
Bajaj Auto CEO (two wheelers) S. Shridhar said in a statement: “We have examined the TVS product, which has same ‘usage, size, and purpose’ like our DTSi engine. We have neither sold nor licensed this technology to anybody and as a clear case of infringement of intellectual property rights, we will take a suitable legal action against TVS Motors on Monday.”
TVS Motors spokesperson Cecil K Dewars had this to say in response: “TVS has not infringed on anyone’s technology. It’s our own technology developed by years of research at our Hosur facility.”

I have gone the article circulated via http://news.techwhack.com/6384/bajaj-auto-to-sue-tvs-motors/ under the caption “Bajaj Auto to sue TVS Motors on Patent Infringement!”. I think that this news is given in abayance. If Bajaj Auto is sure about its infringment, they must adopt the infringment suit in District Court where defendant would have its head office of working, or having business. and If they are not sure about the infringment, they should keep silence, because, such types of news may give the impression in the mind of the layman that another company has actually infringed the patent, but Bajaj Auto themselves (as reflect from this news) are not sure about that their patent number 195904 granted for said DTS-i technology on July 7, 2005 is actually occured or not. the news wihtout proper confirmantion, if leaked in media, give undew advantage to opponant and they are having right to file counter suit for ‘libel’ as appear from their intention. Therefore, it is proper, that if Bajaj Auto is actually feel proper that their patent has got infrignemtn by competitor, they first get it confirmed and file and injunction suit to restrain them. Such news would spoil the repuatation of both in the market, and hardly seems to be carved out of real truth.
